"we must do something because the system is broken." but to say the system is broken is to remove responsibility from politicians who refuse to

enforce the current law and the individuals who willfully break them. mexico, yesterday, the president off-teleprompter by the way, said we shouldn't be bogged down on border issues. bogged down on border issues? does it sound like someone serious about enforcement? by the way, cbs news reported this week illegal crossings in one border area, have nearly tripled since january. that means promise of amnesty is a huge magnet. former mayor rudy giuliani told me last week on radio enforcement provision in the proposed bill will not work. since janet napolitano can waive most of the requirements. suddenly marco rubio has gone from saying the bill contains the toughest border control ever to it might not pass the senate if it's not strengthened. the meantime, immigration and custom enforcement announce it today effective immediately it

will track student visa holders to make sure they are enrolled in school. of course, they were shamed in to doing this because of the revelations that two of the boston bombers held violated student visa requirements. it's pathetic. oh, by the way, remember the national security entry/exit registration system supposed to give extra scrutiny for visa holders from countries the w terror ties? obama ditched it. the system is not broke bun the politicians are. that is a memo. now the top story. the latest in the investigation in the boston bombing. dzhokhar tsarnaev reportedly told the f.b.i. that he and his brother tamerlan originally planned the attack for july 4 but moved it up to patriots day because they finished building the bombs ahead of schedule. fox news confirmed that the feds believe bombs were assembled inside his brother's cambridge apartment. that raises new questions about the dead suspect's wido

apart. and that will happen with virtually -- you pick your person, any black person who says something that is not the described things they expect from a black person will be picked apart. don't pick me. pick anyone who decided not to go along with it. there is a price to pay. somebody the media agrees with. >> laura: i clerked for justice thomas in supreme court in the early '90s. we're joined by reverend jacque degross to weigh in on the issue. what do you make of justice thomas' comments there? >> i appreciate his sensitivity from what he went through in the nomination hearings. but the fact of the matter is every african-american who stepped forward for major office at the presidential level and other office undergone excruciating

scrutiny. look at what obama went through. they talked about his momma, his birthplace, his pastor and religion. wreligion. nobody else asked for their transcript -- >> laura: we haven't seen. we haven't seen his crypt. >> nobody else for anybody else's? >> have they been withheld -- >> no one asked for them. >> laura: you think -- >> why would you ask for it? other than him being african-american and the implication for affirm tv action -- >> laura: wait. i don't want to get hung up on that. but you are saying that the reason people want to know his grades in college and law school is because he is black? >> i'm saying -- >> laura: really? >> no white candidate has been asked that? >> laura: because i believe people release their transcripts and for the most part you know what the gpa is. i don't think it's the reason they're asking for that. i don't know what the big deal is release the transcript.

let's move on to what justice thomas said. you speak all the time and talk to a lot of people. do you disagree that conservatives, african-americans, are held to a different standard or critique differently than more liberals, left-leaning african-americans in public life? justice thomas. do you think they are treated differently by the elite? >> perceived differently. consequently they're subject to scrutiny in the media. but no differently than the african-american media with the great support in their own community received by the mainstream media. >> so you don't think -- >> you don't think there -- if colonel west for instance, happened to be a liberal.

against defense of marriage or a bunch of issue, don't you think that colonel west would have got an different ride in the national media than when he was running for re-electio re-election? >> a lot of people neglect that media is about relationships. you said you clerked for justice thomas. and there is nothing wrong with that. >> laura: thanks. nothing wrong with it. great honor. wait, what do you mean nothing wrong with that? >> that's not the point i'm making. but the point is you have relationships. people have relationships and they allow people have access. that is central to the idea. >> so,b, colonel alan west and ben carson need to be nicer to the media figures to get better coverage? >> if they have views closer to mainstream america they would get -- >> the views are closer to mainstream america. we appreciate it. reverend, thank you so much. directly ahead the push for hillary in 2016 has officially but gun. she has too much to win the

>> laura: thank you for staying with us. i'm laura ingraham in for bill o'reilly. in the factor flashback segment, new unemployment numbers came out today and the stats are grim for black americans. unemployment stands above 13% in that group. about half that for white americans. 6.7%. recently the founder of black entertainment television network said this. >> this country would never tolerate white unemployment at 14 to 15%. no one would ever stay in office at 14% to 15% unemployment in this nation. but we had that double unemployment for over 50 years. >> laura: bill recently spoke with bob johnson. >> so, here is what i don't understand. 93% of african-americans voted for president obama last november. even though black employment is so high.

why? >> well, i think first of all, african-americans have immense pride in president obama as a president. they see it as a major accomplishment in this country. and embracing an african-american leader. and they are positive and hopeful, probably, more than anything else, that his leadership will make their lives better. >> all right, but it didn't turn out that way. he had four years to improve. the black unemployment rate. and it's not improving. so are you saying that african-american community en masse is voting on hope. hope it will get better but it hasn't gotten better. >> yeah. i would say, bill, african-americans have been living under this unemployment problem, this gap for over 50 years, if you look at the bureau of labor statistics. >> i have them here. >> african-american employment has been double that of white for over 50 years.

>> let me give you -- >> give you stats. in the year 2000. all right, when president bush was elected, first term. black unemployment was below 8%. it went up a little bit and down again in 2007. to 8%. under president obama that has risen from when the president took office, it was about 10%. it has riz o risen to 14%. there has been with everybody else, may have been a flow in black unemployment. let me ask you this: i believe that the primary problem in the african-american community is out of wedlock birth. 71%. that drives poverty. it makes educating kids harder because they are not supervised and they don't have a dad in the home many times. am i wrong on that? >> i think you are wrong saying it's the primary driver of african-american unemployment.

it's one of the social factors that african-americans face. to me the principal drivers are the failure of corporate america to hire enough african-americans who are qualified, for african-americans to get access to capital to start small businesses, great engine to create employment and legacy of long-term institutionmized racism that has plagued blacks in a situation for example, bill, the last 20 years the wealth gap increased by $70,000 among african-americans and whites. according to the pew research center. in addition, african-american median income is one-tenth of that of white americans. when you add the dislocation in the economy, not all of them caused in any way by the recession, but a big part of it, global competition. and other things in terms of the u.s. manufacturing of business, african-americans are usually the last hired

and first fired. >> do you believe's a skin color issue rather than performance issue? >> i have been convinced all my life -- i have been in business all my life. i have been quite successful as you might know. but i will tell you this, there are millions of african-americans who have the talent, the work ethic, integrity, ingenuity to be successful in jobs and in business, but you have to admit that anytime you have a situation for 50 years, dating back to the civil rights movement, when african-americans were making huge gains in fair employment and housing and legislation was enacted we spent more money on education than at any time in the african-american history, there is something here than just failure of family or failure of individual african-american to pursue a job. it has to do where the fact that the question of race discrimination lingers on -- >> you are laying it on the skin color and i can't tell

>> laura: in the friday with geraldo segment tonight, disturbing situation in sacramento, california. late last month a young couple, alex and anna nocolia took their 5-month-old son sammy to the hospital where he started to exhibit flu-like symptoms. doctors there told them their baby needed open heart surgery. but the parents wanted a second opinion. so they left with little sammy against the hospital's medical advice. that prompted the hospital to call police who showed up at the nikolia's home along with representatives from child protective services, and then they took sammy away from his parents. the entire incident was caught on tape.

>> laura: shocking, right? the good news earlier in week, sacramento judge returned custody to the parents. but cps will continue to monitor their case. joining me now from our new york studio with more details is fox news anchor geraldo rivera. geraldo, russian immigrant parents, told their child needed open heart surgery, a big operation. they wanted a second opinion.

how did that end up resulting in the child being taken away from them? >> start there. start with the fact they are, laura, russian immigrants. they came to the united states to the land of freedom. little did they expect that the state, the totalitarian entity would crack down on them and take the little baby from their arms in their home without a warrant and place the child in protective custody. they were no allegations as far as i know that these were abusive parents. you mentioned the conflict, the rub that came down. so here is the child born with a heart murmur, a child that is chronically ill and cared for at the hospital which is a fine hospital by most account. the parents watch the child being care for begin worry. worry about the quality of care and the nurse for example, administering an antibiotic to the child, even though the parents thought the doctor said an antibiotic in the current circumstance was not warranted.

they're worried as any parent would be worried about a little baby. what did they do in they say we need a second opinion. they take the child, the baby, if this is their fault -- they should have checked the child through the procedures but they were worried. do gent circumstances -- do gent circumstances. they give it to attending physician. allow parents to take the child home. before they do, the authorities, cops, are called to the second hospital, question doctors and the doctors say no, it's fine. take the child home. they do. next day child protective services at the door. awful scene. imagine if it's you and your child. >> laura: there are 3 million child protective service cases every year in the united states.

3,000 in protective custody. we need child protective services but we need them to be trained. a lot of them roll through quickly and they're staffers short termers in the system. and we are concerned with their level of training. needs common sense. >> not only that. they are never challenged. they have melancholy job. we never minimize the task they have. it's difficult and they have to protect the children but they have to listen to reason. this is not an abusive situation. these were not crazy people. these were not the foster parent who ashes from the cigarette drop on the baby. these were loving parents doing the best by the baby. >> laura: and they shouldn't continue to be monitored by state either. that's what we hear from the
